BaseHV Terms of Service

These Terms of Service ("Terms") govern your use of basehv.com (the "Site") and your interactions with BaseHV, a product of Novavirt Inc. ("Novavirt," "we," "us," or "our"). By using this Site, you agree to these Terms.
BaseHV is an early-stage product. These Terms reflect that honestly — this is not a mature SaaS product with years of legal precedent behind it, and we'd rather be direct about that than pretend otherwise.
1. About This Site
This Site provides information about BaseHV, a KVM/libvirt-based hypervisor management platform, and allows you to request early access. It does not currently offer self-service purchasing, account creation, or software downloads directly.
Actual licensing of BaseHV software, once you're onboarded as a customer, will be governed by a separate license agreement provided to you at that time — not solely by these Site Terms.
2. Acceptable Use
You agree to use this Site only for lawful purposes. You agree not to:
- Attempt to gain unauthorized access to this Site, its infrastructure, or any accounts
- Use automated means (bots, scrapers) to access the Site in a way that degrades its performance or availability
- Submit false or fraudulent information through the Request Early Access form
- Use the Site to transmit any harmful code, malware, or attempt to disrupt its operation
3. Early Access Requests
Submitting the Request Early Access form does not create a contract, purchase, or binding commitment of any kind — from you or from us. It is an expression of interest. We will reach out personally if and when we're ready to onboard early adopters, at our own discretion and on our own timeline. We make no guarantee about when, or whether, we will do so for any particular request.
4. Intellectual Property
All content on this Site — including text, graphics, logos, the BaseHV name and branding, and the underlying design — is the property of Novavirt Inc. or its licensors, and is protected by applicable intellectual property laws.
BaseHV's underlying software (KVM and libvirt) incorporates open-source components licensed under their respective open-source licenses. Nothing in these Terms is intended to restrict your rights under those open-source licenses with respect to those specific components. BaseHV Center and BaseHV Agent, the software Novavirt has built on top of that open-source foundation, are proprietary to Novavirt Inc.
You may not copy, reproduce, or use Site content for commercial purposes without our written permission.
5. No Warranty
This Site and the information on it are provided "as is," without warranty of any kind, express or implied.
BaseHV is an actively developing product. As disclosed directly on this Site, certain capabilities (including Fibre Channel LUN management and content library/template management) are still in active development. We make reasonable efforts to keep this Site accurate, including the "Delivery Status" information shown for BaseHV's capabilities, but we do not guarantee that all information on this Site is complete, current, or error-free at every moment.
Any future license agreement for BaseHV software itself will contain its own, more specific warranty terms.
6. Limitation of Liability
To the fullest extent permitted by law, Novavirt Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site, or from any early access request, communication, or interaction that follows from it.
Nothing in these Terms is intended to limit liability in ways not permitted by applicable law.
7. Third-Party Services
This Site relies on third-party infrastructure providers, including Railway (hosting) and Cloudflare (content delivery and security). We are not responsible for outages, errors, or issues originating from these third-party services, though we will make reasonable efforts to maintain Site availability.
8. Changes to These Terms
We may update these Terms as BaseHV and this Site evolve. We'll update the "Last updated" date above when we do. Continued use of the Site after changes means you accept the updated Terms.
9. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law principles, as Novavirt Inc. is a Wyoming corporation.
